Liability For McHenry Bicycle Accidents

Thousands of people are seriously injured every year in bicycle accidents. According to the Centers for Disease Control, “Nearly 1,000 bicyclists die and over 130,000 are injured in crashes that occur on roads in the United States every year. The costs of bicycle injuries and deaths from crashes typically exceed $23 billion in the United States each year.” There are a number of steps that city’s can take in order to help prevent bicycle accidents.

  • Roads and intersections should be well illuminated.
  • City officials should work to determine which intersections and roads have the most accidents.
  • Police officers should be trained to enforce traffic citations most likely to lead to pedestrian and bicycle accidents.

All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horn when necessary and exercise the proper precaution to avoid colliding with any child or obviously confused person. When a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim.

Depending on the facts of any case, liability for a bicycle accident could extend beyond any driver. Pickup trucks are often used for commercial purposes. If a pickup truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful acts of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of truck accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

The vast majority of bicycle accidents are preventable and involve some amount of driver error. In many situations, drivers may be distracted or traveling too fast for the prevailing conditions. It is important that accident victims understand their rights after any collision. Any person that is injured due to the negligence of another driver may be able to seek some measure of justice through a civil claim.
