Liability For Macon County Motorcycle Accidents
Motorcyclists have a small profile and are uniquely vulnerable to the hazards posed by car accidents. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022.” Drivers should take a number of measures in order to prevent motorcycle accidents.
- Drivers should slow down during periods of reduced visibility and inclement weather.
- Drivers should use their turn signals in order to alert others to their intentions.
- Drivers should maintain a safe distance from all vehicles ahead of them.
Every driver has a legal obligation to exercise due care in order to avoid collisions. Many motorcycle accidents are due to drivers who make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-707), no person shall make a left turn or U-turn upon a roadway unless such a movement can be made with reasonable safety. If a driver fails to yield the right of way to a vehicle close enough so as to pose a hazard, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer very serious injuries.
- Broken bones
- Lacerations
- Head injuries
- Organ damage
The vast majority of motorcycle accidents are preventable and involve some amount of negligence. This is especially true when drivers are making turns. Drivers are often distracted as they check for cross-traffic. It is important for accident victims to understand that they do have rights. Any person who is injured due to the negligence of another driver may have legal recourse through a civil claim.
