Liability For Decatur Car Accidents
Motorcyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022. A factor that directly influences motorcycle fatality trends is helmet use.” There are a number of steps that drivers should take in order to avoid car accidents.
- Drivers should check their blind spots before making turns.
- Drivers should use their turn signals to alert other drivers of their presence.
- Drivers should slow down during periods of inclement weather.
All drivers have a legal obligation to exercise due care in order to avoid causing accidents. Many collisions are due to drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-707), no person shall make a left turn or U-turn upon a roadway unless such a movement can be made with reasonable safety. If a driver makes a left turn into the path of another vehicle prior to a collision, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The vast majority of motorcycle collisions are completely preventable. They tend to take place when drivers make dangerous turns or are not paying attention to the road ahead of them. It can be hard to know where to begin after any car accident. It is important that victims understand that they do have legal options. They are able to seek some measure of accountability through a civil claim.
