Liability For Joliet Motorcycle Accidents
Motorcyclists are uniquely vulnerable to the hazards posed by vehicle collisions. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022.” A number of different factors can contribute to motorcycle collisions.
- Drivers may fail to check their blind spots.
- Drivers may travel too fast for the prevailing conditions.
- Poor road conditions could also contribute to a collision.
- Vehicle system failures, such as tire blowouts, may lead to a collision.
All drivers have a legal obligation to take the necessary precautions to avoid hitting other vehicles and motorcyclists. Many collisions involve drivers who make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-707), no person shall make a left turn or U-turn upon a roadway unless such a movement can be made with reasonable safety. If a driver makes a left turn into the path of a motorcyclist, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer many injuries, including:
- Broken bones
- Head injuries
- Internal injuries
- Spinal cord injuries
Depending on the facts of any case, liability for a car accident could extend beyond any driver. Pick-up trucks are often used for a variety of commercial purposes. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person injured in a motorcycle collision may have legal recourse through a civil claim.
