Liability for Cook County Dump Truck Accidents

Dump trucks can weigh tens of thousands of pounds and can be very dangerous to other road users. According to the Texas Department of Insurance, “The Bureau of Labor Statistics reports that 536 dump truck-related deaths and 7,270 serious injuries occurred in the U.S between 2015 and 2020. Many of these resulted from tip-overs caused by unbalanced loads.” Dump truck drivers should take several actions to avoid collisions.

  • Breaks: Dump truck drivers must be well rested before the start of their shift and take periodic breaks as required by law.
  • Blind Spots: Dump truck drivers should check their blind spots before making turns or changing lanes in the roadway.
  • Scanning: Dump truck drivers should continuously scan the road ahead of them for potential hazards.

Most dump truck drivers must get a commercial license when the vehicle exceeds 26,000 lbs. These drivers are expected to operate their vehicle with an abundance of caution. Among other things, all dump truck drivers must operate at a safe speed at all times. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-601, no vehicle shall be driven upon a highway at a speed greater than what would be reasonable or prudent given the prevailing conditions of the roadway. If a dump truck driver fails to slow down to avoid colliding with a motorcyclist, this could form the basis of a negligence claim.

When a dump truck driver is negligent and causes a collision, their employer could potentially be held at fault. Employers are typically variously liable for the wrongful actions of their workers–insofar as those employees were operating within the course and scope of their job duty. The company responsible for maintaining a truck could also be held at fault. Damaged tires, mirrors, and brake pedals are known to have caused catastrophic accidents in the past. It is important that certain steps are taken after any dump truck accident.

  • The condition of the truck involved in the accident should be scrutinized.
  • The safety record of the driver involved in the collision should be examined.
  • Medical records related to injuries should be preserved.
  • Surveillance footage of the accident should be sought.

Being injured in a truck accident can be one of the worst things that most people will go through in their lives. Victims are often left with high medical bills and may need to take extensive periods of time away from work. Losing a loved one in a truck accident can be absolutely devastating. To make matters worse, the companies that operate these trucks will do everything in their power to deny responsibility for what happened.
