Liability In Ogle County Motorcycle Accidents

It has been estimated that motorcyclists are 29 times more likely to be killed in a car accident than those in passenger vehicles. They are often overlooked due to their small profile. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 14% of all traffic fatalities, 18% of all occupant fatalities, and 4% of all occupant injuries in 2020.” There are a number of factors that could potentially contribute to any motorcycle collision.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver intoxication

All drivers have a legal obligation to exercise due care in order to avoid causing accidents. Many collisions are due to drivers that fail to yield to motorcyclists. According to Illinois Vehicle Code (625 ILCS 5/11-902), all drivers intending to turn to the left must first yield the right of way to all vehicles traveling from the opposite direction that are close enough to pose a hazard. If a pickup truck driver fails to yield to a motorcyclist, they could be held at fault for the collision. There are many steps that should be taken after any collision.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • It should be determined if an intersection has a history of collisions.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden and tragic loss of a love one. It is crucial that evidence is properly preserved after any accident. Evidence is what will ultimately be used to determine liability. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
