Liability for Illinois Truck Accidents
Motorcyclists lack the protection of enclosed vehicles and are susceptible to being seriously injured in motor vehicle accidents. According to the NHTSA, “In 2023, there were 6,335 motorcyclists killed — 15% of all traffic fatalities. NHTSA data show that this is the highest number of motorcyclists killed since at least 1975.” Drivers should take several actions to avoid colliding with motorcyclists.
- Drivers should check their blind spots before making turns to the roadway.
- Drivers should continuously scan the road ahead of them for potential hazards.
- Drivers should abstain from alcohol and other intoxicating substances.
Every truck driver owes a duty of care to other drivers sharing the road. They must abide by all the traffic regulations and slow down when necessary to avoid collision. Many truck accidents involve drivers who make dangerous left turns. Pursuant to 625 ILCS 5/11-801, the driver of any vehicle intending to turn left at an intersection or into an alley must first yield the right-of-way to vehicles traveling from the opposite direction that are close enough to pose a hazard.
If a truck was being used for a commercial purpose at the time of a collision, the business that owned that truck could be held at fault. In Illinois, employers can be held vicariously liable for the wrongful conduct of their workers who were operating within their job duties. This may include instances where a truck was being used to haul goods from one location to another. Victims of truck accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Many of the injuries associated with truck accidents will not be immediately obvious. This is particularly true if a person hits their head and sustains any type of brain injury. A brain injury can dramatically increase the risk that a person will develop neurodegenerative illnesses. It is important that accident victims understand that they do have legal options. They are able to recover damages through a civil claim.
