Liability For Elk Grove Village Dump Truck Accidents

Dump trucks can be particularly dangerous for many reasons. According to the Engineering News Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” This can be attributed in part to poor driving habits and overworked drivers. Truck drivers are more likely to make mistakes when they are fatigued. There are many steps that truck drivers should take in order to avoid collisions.

  • Truck drivers should check their blind spots before making turns.
  • Truck drivers should slow down during periods of inclement weather or reduced visibility.
  • Truck drivers should be well rested before heading out onto the road.

Truck drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to truck drivers that are speeding. According to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a driver fails to slow down to avoid a collision, this could form the basis of a negligence claim.

Depending on the facts of any case, liability for a dump truck accident could extent beyond any negligent driver. The company that a dump truck driver worked for could also be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of dump truck accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many victims of dump truck accidents may not realize the full extent of their injuries for several weeks or months. For example, many people suffer long-term psychological trauma. Any person that is injured in a dump truck accident may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
