Four students and the school bus driver were all taken to the hospital. A full investigation into the cause of the collision remains ongoing at this time.

Liability For Perry County Semi-Truck Accidents

Semi-trucks account for a relatively small number of the total vehicles on the road. But they are involved in a disproportionate number of traffic fatalities and serious injury collisions. According to the National Safety Council, “Also in 2021, 117,300 large trucks were involved in crashes resulting in an injury, a 12% increase from 2020. Since 2016, the number of trucks involved in injury crashes has increased 15% and the involvement rate per 100 million large truck miles driven has increased 3% to 36.” There are a number of steps that truck drivers should take in order to avoid collisions.

  • Truck drivers should be well rested before the start of their shift.
  • Truck drivers should use commercial GPS systems.
  • Truck drivers should abstain from alcohol and other intoxicating substances.

Both truck drivers and bus drivers are considered common carriers and must do everything that they can to avoid collisions. Many car accidents are due to speeding. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall drive a motor vehicle at a speed greater than what is reasonable and prudent given the prevailing conditions of the roadway. If a driver fails to slow down to avoid a collision, this could form the basis of a negligence claim.

If a commercial driver was working at the time of a collision, their employer could be held at fault. In most situations, employers are liable for the wrongful acts of their employees – insofar as those employees were working within the scope of their job duties. For example, a truck driver may have been transporting goods when they crashed. It is important that evidence is properly preserved after any collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • The driving logbooks for all commercial drivers involved should be reviewed.

Going through a car accident can be one of the most traumatic experiences that people can go through. Victims are often left with high medical bills and may need to take extensive time off of work. In some cases, victims may be left with life-altering injuries. It is important that accident victims understand their rights. Any person that is injured in a Perry County bus accident may have legal recourse through a civil claim.
