Liability For Fairfield School Bus Accidents
School buses are typically very safe for their occupants. But they can be uniquely dangerous for pedestrians and those in smaller vehicles. According to the National Safety Council, “School bus-related crashes killed 104 people nationwide in 2022, down 3.7% compared to the 108 deaths in 2021, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” School districts should take a number of measures in order to prevent bus accidents.
- School districts should ensure that all of their drivers are well trained.
- School districts should regularly inspect and maintain their vehicles.
- School districts should utilize routes that minimize left turns.
School buses are considered common carriers under Illinois law. Their drivers must use a great deal of care in order to prevent collisions. Many collisions involve drivers that make dangerous turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-707), no person shall make a left turn or U-turn upon a roadway unless such a movement can be made with reasonable safety. When a driver makes a dangerous turn in front of another vehicle, this could form the basis of a negligence claim. Victims of car accidents tend to suffer very serious injuries.
- Head injuries
- Broken bones
- Lacerations
- Spinal cord injuries
The vast majority of school bus accidents are preventable. In particular, one or more vehicles may have been traveling at an unsafe speed. Sadly, though, drivers and insurance providers will often do everything in their power to deny responsibility for a collision. It is important for victims to understand that they do have rights and legal options after a collision. Any person injured in a school bus accident may be entitled to damages through a civil claim.
