Liability For Injuries Caused By Lead Contaminated Toys

Childhood exposure to lead is incredibly dangerous and associated with numerous negative health outcomes. According to the World Health Organization, “Lead exposure causes a significant burden of disease. The Institute for Health Metrics and Evaluation (IHME) estimates that more than 1.5 million deaths globally were attributed to lead exposure in 2021, primarily due to cardiovascular effects (2).” There are a number of symptoms associated with lead poisoning.

  • Cognitive and Behavioral Issues: Memory issues, difficulty concentrating, depression
  • Physical Symptoms: Headaches, muscle pains, gastrointestinal problems
  • Neurological Issues: Numbness of the hands and feet, difficulty concentrating

Companies that create children’s products have a legal obligation to ensure that they are reasonably safe. They must abide by federal safety regulations by the Consumer Product Safety Commission. When a company creates a product with design defects, this could form the basis of a strict liability claim. Toys must comply with the Hazardous Substances Act (HSA).

  • Manufacturers must properly label hazardous household products.
  • The HSA bans certain chemicals that are deemed too dangerous, including lead and cadmium.
  • The HSA establishes guidelines for the safe sale and distribution of hazardous substances.
  • The HSA has special provisions for children’s toys to ensure that they are not tainted by dangerous substances.

One of the major sources of dangerous toys is from foreign manufacturers. Many companies that develop toys overseas do not have the same stringent levels of safety regulations found in the United States. In particular, a number of toys tainted by lead have been imported from China. Any person harmed by lead poisoning from toys may have legal recourse through a civil claim. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
