Liability for LaSalle County Semi-Truck Accidents

Semi-trucks weigh substantially more than passenger vehicles and can be incredibly dangerous even at lower speeds. According to the IIHS, “Large trucks often weigh 20-30 times as much as passenger vehicles. They are taller and have greater ground clearance than cars, which means that lower-riding vehicles can slide beneath truck trailers, with deadly consequences. Strong underride guards can prevent that from happening.” Truck companies should take several steps to minimize the risk of collisions.

  • Truck companies should only hire drivers that have the appropriate commercial license for the rig that they will be operating.
  • Truck companies should ensure that all of their vehicles are routinely inspected and well maintained.
  • Truck companies should consider installing key safety features such as forward collision avoidance systems.

Truck drivers have a legal obligation to operate with an abundance of caution in order to avoid collisions. A number of serious accidents occur when one driver makes an unsafe lane change. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-709, a vehicle shall be driven as practically as possible within a single lane and not moved from that lane unless such a movement can be made with reasonable safety. If a driver makes an unsafe lane change that contributes to a collision, they could be held legally responsible.

It is also possible that liability for a truck accident could extend beyond any driver. Semi trucks are nearly always used for commercial purposes. When a truck driver is negligent, their employer could potentially be held at fault. As a general rule, employers are responsible for the wrongful acts of their employees operating within their job duties. However, many truck companies hire their drivers as independent contractors to limit their legal exposure. All evidence related to a truck accident should be well preserved.

  • The logbook of the truck driver should be reviewed.
  • The safety record of the truck company involved should be scrutinized.
  • Photos of the accident site should be taken.
  • Medical records related to the injury should be documented.

The vast majority of truck accidents are preventable. They tend to involve situations where drivers violate key safety standards. Perhaps the most common issue is that truck drivers are traveling too fast for the prevailing conditions. This does not necessarily mean that a truck driver was speeding. A truck driver going the speed limit may be dangerous during periods of heavy traffic or inclement weather. Any person injured in a truck accident may be able to seek financial aid through a personal injury claim.
