Liability for Cook County School Bus Accidents
School buses are typically very safe for children. But they can be very dangerous for pedestrians and those in smaller vehicles. According to the National Safety Council, “School bus-related crashes killed 104 people nationwide in 2022, down 3.7% compared to the 108 deaths in 2021, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” There are a number of factors that could contribute to any school bus accident.
- School buses have large blind spots that can obscure the presence of smaller vehicles.
- School buses have a wide turning radius, which can easily lead to side-impact collisions.
- School buses have a high center of gravity and are therefore more prone to rolling over.
School buses are considered common carriers in Illinois. Their drivers must operate with an abundance of caution in order to prevent collisions. Many collisions are due to dangerous lane changes. Pursuant to 625 ILCS 5/11-709, the driver of any vehicle shall not move from a single lane of traffic until that driver has first ascertained that such a movement can be made with reasonable safety. Victims of school bus collisions tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
If a school bus operator was working in some official capacity at the time of a crash, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person injured in a school bus collision may have legal recourse through a civil claim. A school bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
