Liability For Peoria County Semi-Truck Accidents
Semi-trucks account for a relatively small number of the total vehicles on the roadway. But they are involved in a disproportionate number of fatal collisions. According to the Federal Motor Carrier Safety Administration, “Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” There are a number of reasons why trucks can be dangerous.
- Trucks have large blind spots that can obscure the presence of smaller vehicles.
- Trucks can weigh 80,000 lbs when fully loaded.
- Trucks can take the length of two football fields to come to a complete stop.
All truck drivers have a legal obligation to exercise due care in order to avoid causing accidents. Many of these collisions involve drivers who make dangerous lane changes. Pursuant to (625 ILCS 5/11-701), “a vehicle shall be driven in the right-hand lane available for traffic, or as close as practicable to the right hand curb or edge of the roadway, except when overtaking and passing another vehicle proceeding in the same direction.” If a driver makes an unsafe lane change, this could form the basis of a negligence claim. Victims of truck accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
The vast majority of truck accidents are preventable and involve some amount of driver error. In many cases, truck drivers are pushed to complete their deliveries on unrealistic time schedules. In fact, nearly one in ten truck drivers involved in a fatal collision reported feeling under pressure from their employer. Any person who is injured in a truck accident may be able to seek some measure of justice through a civil claim. A truck accident attorney can examine the unique facts of your case and let you know what your legal options are.
