Liability for Attacks at Chicago Bars

Bars and other commercial establishments in Chicago have a legal obligation to maintain their premises in a reasonably safe condition. They must also protect guests from reasonably foreseeable sources of harm. This includes protecting guests from the criminal acts of third parties. Bars should take a number of actions to prevent assaults at their location.

  • Security: Bars should employ adequate security personnel. They should also maintain adequate staffing levels to control guests based on the size of the crowd.
  • De-escalation: Security at bars should work to de-escalate encounters between patrons. In many cases, they may need to remove patrons from their premises who pose a threat to guests.
  • Surveillance: Bars should install high-resolution cameras and keep all parts of their premises well lit. Cameras and adequate lighting are known to reduce the prevalence of crime.

The specific security measures that any bar may need may vary depending on a variety of factors. Bars in a high-crime area will typically need greater security. Bars that have a history of violence will also need to consider additional security measures. When a bar has actual or constructive notice of a security threat to patrons, they must act. Failing to act could serve as evidence of negligence.

Steps to Take After Chicago Bar Fights

Violence at bars and other locations that sell alcohol remains a common occurrence. According to the Journal of Applied Security Research, “The bar industry is enormous with tens of thousands of locations across the United States. The American Nightlife Association (2011) estimated that 19 million people regularly patronize bars resulting in gross earnings of around $26 billion. The link between bars and violence has been recognized over time and across cultures. The classic “bar room brawl” is commonly depicted in popular culture and all too often people are injured, killed, or sexually assaulted in drinking establishments.” Multiple actions should be taken after any type of bar fight.

  • Victim should seek medical treatment as soon as possible.
  • All surveillance footage that may have captured the assault should be reviewed.
  • The bar’s security measures at the time of the assault should be understood.
  • The family of any victim who died in a bar assault should carefully consider their legal options with a team experienced in premises liability claims.

Fights at bars are far from a random occurrence. They tend to be the results of an escalating series of conflicts between one or more groups of people. Bars are supposed to de-escalate these encounters and remove problematic patrons. But far too often this does not take place. The family of any person who died in a bar assault may be able to see some measure of accountability and justice through a wrongful death claim.
