Who pays for medical bills after a truck accident?

HOFFMAN ESTATES, ILLINOIS (February 13, 2023) – A paramedic was injured in a Cook County semi-truck accident on Interstate 90, not far from Hoffman Estates.

Cook County officials are saying that the accident took place shortly before 2:01 AM on Monday. Paramedics were called to the scene of a collision involving a black Ford sedan and a Kia SUV.

As one paramedic was assisting in the crash, a semi-truck collided with one of the vehicles from the first collision before rolling over. The force of the impact pushed one of those cars into the paramedic.

The victim was transported to the hospital to receive treatments. A full investigation into the truck accident remains ongoing.

Liability for Cook County Semi-Truck Accidents

Truck drivers are required to obtain a commercial license and are expected to operate with a great deal of safety to avoid collisions. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-710, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” There are many ways that a truck driver may have acted negligently prior to a collision.

  • Speed: A truck driver may have been traveling at an unsafe speed given the prevailing road conditions.
  • Distraction: A truck driver may have been distracted by their phone and not looking at the road ahead of them.
  • Fatigue: A driver may have failed to take periodic rest breaks as required by law.

If a truck driver fails to slow down to avoid hitting another vehicle, this could be construed as negligence. It doesn’t matter if the vehicle that they hit was stopped in a lane of traffic. Truck drivers are supposed to maintain an adequate distance to avoid these types of collisions. When a truck driver causes an accident, their employer could also be held at fault. Employers can typically be liable for the wrongful conduct of their employees operating within the course and scope of their job duties.

Steps to Take After Cook County Semi-Truck Accidents

Many people are seriously injured or killed in collisions involving commercial trucks every year. According to the FMCSA, “Of the approximately 503,000 police-reported crashes involving large trucks in 2022, there were 5,279 (1 percent) fatal crashes and 114,000 (23 percent) injury crashes.” Any person injured in a Cook County truck accident should take certain measures to protect their health and legal rights.

  • Medical Treatment: Victims should seek medical treatments, even if they feel all right after a crash.
  • Photos: Lots of photos of the accident site should be taken. A photograph can help reveal what may have led up to a collision.
  • Surveillance Footage: Any footage that may have captured the collision should be sought.
  • Legal Review: Victims should contact an experienced truck accident attorney. An attorney can help accident victims get financial compensation for their injuries.

The vast majority of truck accidents are preventable. They tend to involve situations where truck drivers are distracted or traveling too fast for the prevailing conditions. Unfortunately, truck drivers and insurance providers never accept responsibility when they cause a fatal collision. Any person injured due to the negligent actions of a truck driver may be able to pursue some measure of accountability through a personal injury claim.
