Liability For Chicago Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in the United States. According to the Centers for Disease Control, “Nearly 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2021.1 That’s about one death every 66 minutes. One in six people who died in crashes in 2021 were pedestrians.” There are many factors that could contribute to a pedestrian accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All drivers have a legal obligation to avoid hitting pedestrians in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horn when necessary and exercise the proper precaution to avoid colliding with any child or obviously confused person. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The vast majority of pedestrian accidents are preventable and involve some amount of driver error. A driver may be distracted or traveling too fast for the prevailing conditions. Any person that is injured in a Chicago pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the expenses that come with a serious collision.
