Liability for Harrisburg Pedestrian Accidents
Pedestrians have a naturally small profile and are more likely to be overlooked by drivers. According to the IIHS, “Deaths from motor vehicle crashes with pedestrians have increased 83% since reaching their low point in 2009 and account for 18% of crash fatalities. The rates of pedestrian crash deaths per 100,000 people are highest for people ages 20 and over.” Many different factors could contribute to a pedestrian accident.
- Inclement Weather: Poor weather conditions are one of the leading causes of pedestrian accidents. In particular, rain and dense fog can obscure the presence of pedestrians in the roadway.
- Speeding: A large portion of pedestrian accidents involve a driver who is speeding. Traveling at higher speeds can substantially increase the time it takes for a vehicle to stop safely.
- Driver Intoxication: Another major cause of pedestrian accidents is driver intoxication. It is fairly common for drivers not to realize that many substances could potentially impair them besides alcohol.
Drivers must continuously scan the road ahead of them and use caution to avoid colliding with any pedestrian. This necessitates that they travel at a safe speed at all times. Depending on the prevailing road conditions, a driver may need to travel well below the stated speed limit. If a driver fails to slow down in order to avoid colliding with a pedestrian and the roadway, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
Pedestrian accidents are often highly preventable. Part of the problem is that many drivers fail to properly scan the road ahead of them. The majority of pedestrian accidents occur at intersections, especially when drivers are making left turns. It is easy for a driver to become distracted as they are checking for oncoming traffic. They may simply not notice a pedestrian ahead of them. Any person injured in a pedestrian accident may be able to seek some measure of accountability through a civil claim.
