Liability For West Chicago Pedestrian Accidents
Far too many pedestrians are killed or seriously injured in vehicle collisions every year. According to the Chicago Department of Transportation, “70% of Chicago traffic deaths involved drivers traveling at high speeds. Over half of pedestrians killed in the city are hit by an SUV or larger vehicle.” There are a number of other common causes of pedestrian collisions.
- Pedestrian accidents are more likely when drivers are distracted.
- Pedestrian collisions tend to occur at intersections, especially when drivers are making left turns.
- Pedestrian collisions tend to occur in the early morning and late evening hours when visibility is reduced.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. Drivers should also use their horns and turn signals to let pedestrians know of their intentions. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
Liability for a pedestrian collision could extend beyond any driver. For example, if the vehicle involved in a pedestrian collision was being used for commercial purposes, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employers – insofar as those employees were working within the course and scope of their job duties. Any person injured in a collision may be able to seek some measure of justice through a civil claim.
