Liability For McHenry County Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured in collisions every year. According to the Centers for Disease Control, “In 2021, approximately 7,000 pedestrians were killed in motor vehicle crashes, the most in 40 years. During 2009–2016, approximately 47,000 traffic-related hospital admissions occurred annually among pedestrians.” Drivers should take a number of measures in order to prevent collisions.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should refrain from alcohol and other intoxicating substances.
- Drivers should constantly scan the road ahead of them.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer many serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
It can be hard to know where to begin after a pedestrian accident. Victims often suffer devastating injuries that can impact their ability to work or simply enjoy their lives. Sadly, though, drivers and their insurance providers will often do everything in their power to deny responsibility for collisions. This is why it is so important to seek the guidance of an experienced pedestrian accident attorney.
