Liability for Carbondale Pedestrian Accidents

Every driver in Illinois must use caution to avoid colliding with pedestrians. Pursuant to 625 ILCS 5/11-1003.1, “Notwithstanding other provisions of this Code or the provisions of any local ordinance, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, or any person operating a bicycle or other device propelled by human power and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person.” There are many different factors that could contribute to a pedestrian collision.

  • Pedestrian collisions are more likely to occur if drivers are distracted.
  • Pedestrian collisions often occur at night and during periods of reduced visibility.
  • Pedestrian collisions tend to involve drivers that are speeding.

If a driver fails to reduce their speed to avoid colliding with a pedestrian, this could be construed as negligence. Depending on the facts of any case, there could be several liable parties for any pedestrian accident. For example, a city could bear some legal responsibility for a pedestrian collision if it was caused by a dangerous condition on public property. This could include situations where an intersection has an obstructed line of sight that prevents pedestrians from being clearly seen.

Steps to Take After Carbondale Pedestrian Accidents

Car accidents remained one of the leading causes of preventable injury and death across Illinois and the US. According to the Centers for Disease Control, “Over 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2022. That’s about one death every 64 minutes.” It is important that certain steps be taken after any pedestrian accident.

  • Victims should seek a thorough medical evaluation as early as possible.
  • All of the evidence related to the crash should be preserved.
  • The contact information of any potential eyewitnesses should be sought.

Pedestrian accidents are often highly preventable. They tend to involve situations where drivers are not properly scanning the road ahead of them. Any person injured in a pedestrian accident should take some amount of time to carefully consider all of their legal options. They may be able to pursue damages through a personal injury claim.
