Liability for Madison County Pedestrian Accidents
Drivers in Illinois must use caution to avoid hitting any pedestrians in the roadway. Among other things, drivers must maintain a safe speed at all times. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Truck companies should take several actions to prevent truck accidents.
- Training: Truck companies should ensure that all of their drivers are well trained. Commercial trucks are substantially more difficult to operate than passenger vehicles.
- Maintenance: Truck companies should ensure that all of their vehicles are routinely inspected and well maintained.
- Technology: Truck companies should use technology to help prevent accidents. This includes forward collision avoidance systems that automatically brake to prevent rear-end collisions.
Most pedestrian accidents are preventable. They often involved drivers that are not adequately scanning the road ahead of them. If a truck driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim. The company that a truck driver worked for could also be held at fault. However, many truck companies hire their drivers as independent contractors to avoid direct liability for collisions.
Steps to Take After Madison County Truck Accidents
Many pedestrians are seriously injured or killed each year in accidents with commercial trucks. According to the IIHS, “Most deaths in large truck crashes are passenger vehicle occupants. The main problem is the vulnerability of people traveling in smaller vehicles. Trucks often weigh 20-30 times as much as passenger cars and are taller with greater ground clearance, which can result in smaller vehicles underriding trucks in crashes.” Victims of truck accidents should take steps to protect their rights.
- Medical Evaluation: Victims should seek a thorough medical evaluation as early as possible. Many of the injuries associated with a semi-truck accident will not be immediately obvious.
- Physical Evidence: All of the physical evidence related to the crash should be collected and preserved. This will include photos of the accident site and any physical debris left over from the crash.
- Independent Review: Any person injured in a semi-truck accident should seek the legal guidance of an experienced truck accident attorney. An attorney can help you receive compensation for your ordeal.
Semi-truck accidents are often highly traumatic. Victims may need to take extensive periods of time away from work. They could also be left with life-altering injuries. To make matters worse, truck companies and their insurance providers will virtually never accept responsibility if one of their drivers injures a pedestrian. This is why it is so important to seek legal guidance. An attorney can evaluate the unique facts of your case and let you know how much compensation you may be entitled to.
