Liability For Chicago Hit-And-Run Collisions

Pedestrian collisions are unfortunately very common across Chicago. According to ABC7 Chicago, “The ABC7 Data Team found that throughout 2022 in Chicago, 2,468 pedestrians were struck by cars, an increase of 9% from the year before. At least 40% were hit-and-run crashes.” Pedestrian collisions are much more likely to occur during the early morning and late evening hours when pedestrians are less visible. There are many steps that city officials can take to reduce pedestrian collisions.

  • City officials should study which streets and intersections are most likely to have accidents.
  • City officials can install traffic calming measures at locations with a history of speeding.
  • City officials can make more areas of the city free of vehicles.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Many collisions are due to drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-902), the driver of any vehicle intending to turn left must first yield the right of way to any vehicle traveling from the opposite direction and close enough so as to pose a hazard. Victims of pedestrian collisions tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

If a driver flees the scene of an injury collision, they could face criminal sanctions in addition to civil liability. Many drivers flee collisions because they are nervous or intoxicated. Any person that is injured in a car accident due to the negligence of another driver may have legal recourse through a civil claim. Damages can help cover many of the expenses that come with a serious collision.
