Liability For Rock Island Pedestrian Accidents

Thousands of people are killed or seriously injured in pedestrian collisions every year. Certain factors influence the likelihood of pedestrian collisions. According to the National Safety Council, “in 2021 most pedestrian traffic deaths occurred in urban settings (84%), on the open road (77%) versus intersections (23%), and during dark conditions with or without artificial lighting (74%). The largest number of pedestrian deaths occur on Fridays (1,248), closely followed by Saturdays (1,220), and the majority of these deaths happen during dark conditions.” Drivers should take a number of steps in order to avoid hitting pedestrians.

  • Drivers should check their blind spots before making turns.
  • Drivers should slow down at night and during times of inclement weather.
  • Drivers should abstain from alcohol and other intoxicating substances.

All drivers have a legal obligation to avoid causing accidents. Pursuant to 625 ILCS 5/11-1003.1, drivers should slow down and use their horn when necessary to alert pedestrians of their presence. Drivers must be especially cautious around pedestrians or any confused person in the roadway. When drivers fail to slow down to avoid hitting pedestrians, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The vast majority of car accidents are preventable. They often involve drivers that were either distracted or speeding. Any person that is injured in a pedestrian collision may have legal recourse through a bodily injury claim. Damages in a civil claim can help with many of the expenses that often come with serious injuries. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
