Liability For Silvis Pedestrian Accidents

Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. According to the Centers for Disease Control, “Nearly 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2021.1 That’s about one death every 66 minutes. One in six people who died in crashes in 2021 were pedestrians.” Many different factors could contribute to a pedestrian accident.

  • Pedestrian collisions are more likely to take place on high-capacity urban roads.
  • Pedestrian collisions are more likely to happen during the early morning and late evening hours when visibility is reduced.
  • Pedestrian collisions are more likely to occur when drivers are speeding.

All drivers have a legal obligation to take measures to avoid causing car accidents. According to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. Most pedestrian accidents involve some amount of driver error.

Depending on the facts of any case, liability for a pedestrian collision could extend beyond any driver. Pickup trucks are often used for commercial purposes such as construction and landscaping. If a pickup truck driver was working at the time of a collision, their employer could be held at fault. Employers are typically liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of pedestrian accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

Going through a serious car accident can be very difficult. Victims of pedestrian accidents are often left with high medical bills and may need to take significant periods of time off of work. Any person that is injured due to the negligent actions of a driver may be able to seek some measure of justice through a bodily injury claim. A pedestrian accident attorney can examine the unique facts of your case and let you know what your legal options are.
