Liability For Collinsville Pedestrian Accidents
Pedestrians have a small profile and are more likely to be overlooked by drivers. Small children and elderly people account for a disproportionate number of those injured in pedestrian accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” There are many steps that drivers should take to avoid pedestrian collisions.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should be well rested before they head out onto the road.
- Drivers should use their turn signals to let pedestrians know of their intentions.
Every driver must exercise due care in order to avoid pedestrians. Pursuant to 625 ILCS 5/11-1003.1, drivers should slow down and use their horn when necessary to alert pedestrians of their presence. Drivers must be especially cautious around pedestrians or any confused person in the roadway. When drivers fail to slow down to avoid hitting pedestrians, this could form the basis of a negligence claim. If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. There are many steps that should be taken after any pedestrian collision.
- Surveillance footage of the crash should be sought.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
- A thorough investigation should be conducted.
Most pedestrian accidents are preventable. The family of any person that died in a pedestrian accident can seek accountability through a civil claim. Plaintiffs in a civil claim will need to demonstrate negligence. Negligence is the failure to use the care expected of a reasonable, prudent person in a similar set of circumstances. It is very important that all evidence is properly preserved after any collision.
