Liability For DuPage County Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in the United States. According to the National Safety Council, “in 2021 most pedestrian traffic deaths occurred in urban settings (84%), on the open road (77%) versus intersections (23%), and during dark conditions with or without artificial lighting (74%). The largest number of pedestrian deaths occur on Fridays (1,248), closely followed by Saturdays (1,220), and the majority of these deaths happen during dark conditions.” Drivers should take a number of measures in order to prevent pedestrian collisions.

  • Drivers should check their blind spots before making turns on the roadway.
  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should abstain from alcohol and other intoxicating substances.

The vast majority of pedestrian accidents are preventable and involve some amount of driver error. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601), all drivers must not operate their vehicles at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. Drivers must also use caution to avoid hitting children or any confused person on the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It is also possible that a city or municipal entity could be liable for a pedestrian collision. Government entities that control or maintain roadways have a legal obligation to make sure that those roadways are in a reasonably safe condition. If a road was in a dangerous condition and this contributed to a pedestrian accident, the entity responsible for the road could be held at fault. The family of any person who died in a pedestrian collision may be able to seek some measure of justice through a wrongful death claim.
