Liability For Macon County Bus Accidents

Thousands of people are seriously injured in bus collisions every year. According to the National Transportation Safety Board, “Nationwide, more than 700 million passengers — nearly the entire population of Europe — are transported by buses annually. Most travel to and from their destinations safely. Yet despite the strong safety record of buses … there were more than 250 people killed and 20,000 injured in bus-related crashes in 2009.” Most of the victims are pedestrians and those in smaller vehicles. There are several reasons why buses can be dangerous.

  • Buses have large blind spots that can obscure the presence of other vehicles.
  • Buses can weigh 10 times more than passenger vehicles, thereby making even low speed collisions very dangerous.
  • Buses have a wide turning radius, which can increase the odds of side-impact collisions.

Buses are considered “common carriers” and are held to strict safety standards set forth in the Common Carrier Liability Act (740 ILCS 25/). Bus drivers must exercise the utmost care in order to avoid collisions. Despite this, many bus collisions involve speeding. According to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a bus driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. Victims of bus accidents tend to suffer very serious injuries.

  • Head injuries
  • Broken bones
  • Lacerations
  • Internal injuries
  • Psychological injuries

When a person is involved in a bus accident, they will typically be filled with adrenaline from the shock of what just happened. This can easily mask the presence and severity of the injuries that a person sustains. Indeed, many of the injuries associated with bus accidents may not be immediately obvious for several days or weeks. Any person who is injured in a bus accident may be able to seek some measure of justice through a civil claim. A Decatur bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
