Liability for Decatur Car Accidents

Drivers must use caution to avoid colliding with other vehicles in the roadway. They must be particularly cautious around pedestrians. Pursuant to 625 ILCS 5/11-1002, “When traffic control signals are not in place or not in operation the driver of a vehicle shall stop and yield the right-of-way to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.” There are many ways that a driver may have acted negligently prior to hitting a pedestrian.

  • A driver may have been traveling at an unsafe speed.
  • A driver may have been intoxicated by alcohol or other substances.
  • A driver may have failed to check their blind spots before making turns.

When a driver fails to slow down to avoid colliding with a pedestrian, this could form the basis of a negligence claim. Drivers that flee the scene of injury collisions could also face criminal liability for their actions. There is no excuse for a driver to ever leave the scene of an accident. Liability for a collision could extend beyond any particular driver who is deemed to be at fault. This could include a city or property owner if a roadway was in a dangerous condition.

Common Injuries Associated With Pedestrian Accidents

Car accidents remain a major cause of preventable injury across Illinois and the United States. According to the AAA Foundation for Traffic Safety, “In 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit-and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975. ” Victims of pedestrian accidents tend to suffer very serious injuries.

  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Even if a person’s physical injuries are completely healed after a car accident, many victims are left with long-term psychological trauma. Sadly, drivers and their insurance providers virtually never accept responsibility after any pedestrian accident. They are more likely to blame the victim or other third parties. It is important that the victims of these glaciations understand that they do have rights. They are able to seek some measure of accountability through a civil claim.
