Liability For Workplace Accidents At Berwyn

Despite improved safety standards, thousands of workers are killed or seriously injured each year. According to the Bureau of Labor Statistics, “There were 5,486 fatal work injuries recorded in the United States in 2022, a 5.7-percent increase from 5,190 in 2021. The fatal work injury rate was 3.7 fatalities per 100,000 full-time equivalent (FTE) workers, up from 3.6 per 100,000 FTE in 2021.” There are a number of common causes of workplace accidents.

  • Poorly maintained equipment and a lack of safety guards can easily contribute to accidents.
  • Accidents are much more likely to occur when workers do not receive proper training.
  • Accidents often occur when machinery is not properly maintained.

When a worker is injured on the job, they will typically have recourse through worker’s compensation. The worker’s compensation system in Illinois is based off of a no-fault insurance scheme. There is no need for an injured worker to demonstrate liability after any accident. Depending on the facts of any case, an injured worker may also be able to seek aid through a third party liability claim.

A third party claim may be possible if an entity separate from a worker’s employer was responsible for an accident. For example, the company that manufactured any piece of equipment at a business could be liable for an accident if machinery malfunctioned. It is important that evidence is properly preserved after any accident.

  • Eye witnesses should be interviewed.
  • The cause of a machinery malfunction should be understood.
  • Medical records related to the accident should be preserved.
  • An experienced personal injury attorney should be contacted.

When a person is not working and is injured at a business, they may have a legal claim against the company involved. Sadly, though, companies will often take a number of measures in order to deny liability if someone is injured on their premises. A premises liability attorney can examine the unique facts of your case free of cost and let you know what your legal options are.
