Liability for Oswego Motorcycle Accidents
Every driver in Illinois has a legal obligation to use caution to avoid colliding with other vehicles in the roadway. Drivers must be particularly cautious as they are making turns. According to 625 ILCS 5/11-804(a), “No person may turn a vehicle at an intersection unless the vehicle is in proper position upon the highway as required in Section 11-801 or turn a vehicle to enter a private road or driveway, or otherwise turn a vehicle from a direct course or move right or left upon a roadway unless and until such movement can be made with reasonable safety.” There are many factors that could contribute to any motorcycle accident.
- Blind Spots: A driver may fail to check their blind spots as they are turning at a driveway or into an intersection.
- Distraction: A driver that was turning into a location may have been distracted by their phone or other object.
- Fatigue: A driver may have stayed awake for a long period, which impaired their ability to operate a vehicle safely.
If a driver turns into the path of another vehicle prior to an accident, this could serve as evidence of negligence. Drivers must take into consideration the speed of oncoming vehicles and only turn when it is safe. Liability for a car accident can extend to several different parties beyond any one driver determined to be at fault. In particular, the company that a driver was working for could potentially be liable for a crash. Vans and pickup trucks are routinely used for a variety of different commercial purposes.
Steps to Take After Oswego Motorcycle Accidents
Motorcyclists lack the protection of enclosed vehicles and are more likely to be seriously injured or killed in the event of a crash. According to the IIHS, “A total of 6,335 motorcyclists died in crashes in 2023. That is the highest number ever recorded and a 26% increase since 2019. Motorcycle deaths accounted for 15% of all motor vehicle crash deaths in 2023 and were about triple the number of motorcyclist deaths in 1997.” Certain actions should be taken after any motorcycle collision.
- The police should be called to the scene so that they can begin investigating.
- All of the medical records related to injuries should be sought.
- The history of collisions at the intersection should be investigated.
- The family of any person who died should seek an independent review by a team experienced in accident reconstruction and negligence claims.
Car accidents tend to be highly preventable. It has been estimated that nearly 92% of collisions involve some amount of human error. Unfortunately, drivers and their insurance providers will rarely accept responsibility when they cause a crash. This is why it’s so important that these incidents are thoroughly investigated by an outside party. The family of any person who died due to the negligent actions of another driver may be able to seek some measure of accountability through a wrongful death claim.
