Swagtron SG-5 Swagger 5 Boost Commuter Electric Scooters Recalled Over Fire Hazard

CHICAGO, ILLINOIS (March 7, 2025) – Walmart has issued a recall for the Swagtron SG-5 Swagger 5 Boost Commuter Electric Scooters that contain lithium-ion batteries.

The recall was issued on February 20, 2025. Approximately 17,970 units were sold prior to the recall.

According to the Consumer Product Safety Commission, the lithium-ion batteries on the Swagtron SG-5 Swagger 5 Boost Commuter Electric Scooters may overheat and catch fire.

The manufacturer has received seven reports of the batteries on the scooters overheating, smoking, or igniting. At least one of the incidents resulted in a fire that caused a burn injury and property damage.

Liability for Fires Caused by Lithium-Ion Batteries

Lithium-ion batteries are extremely common and in literally billions of devices across the world. These batteries can occasionally pose a serious fire risk. According to the City of New York Fire Department, “In 2024, 277 fires were started by lithium-ion battery fires, compared to 268 in 2023. 133 of these fires were non-structural, meaning that they occurred outdoors and not in an apartment, business, or home. In 2023, only 90 fires were non-structural.” There are a number of reasons that lithium-ion batteries may catch fire.

  • Lithium-ion batteries can experience thermal runaway when they overheat. This can create a self-sustaining cycle that leads to increased temperatures and possibly a fire.
  • Lithium-ion batteries may catch fire due to overcharging beyond the battery capacity.
  • Lithium-ion batteries may catch fire if they are punctured or otherwise seriously damaged.
  • Lithium-ion batteries may catch fire if they are exposed to outside conductive materials.

Companies that create products with lithium-ion batteries have a legal obligation to ensure that they are reasonably safe. They must perform tests to account for all of the ways that their product could likely be used and even misused. Product manufacturers must follow all regulatory guidelines in order to reduce the risk of overheating and fire as much as possible. In particular, IEC 62133 sets safety standards for rechargeable lithium-ion batteries that are used in consumer products. It is important that certain steps are taken after any accident or injury caused by a product with lithium-ion batteries.

  • A report of the incident should be created.
  • The product involved in the accident should be preserved and inspected if possible.
  • It should be determined if the product that caused the incident was on any recall list.
  • An experienced product liability attorney should be contacted.

Lithium-ion battery fires are often highly preventable. They tend to involve products that fail to meet certain safety standards. Manufacturers will typically do everything in their power to reduce costs as much as possible. This may lead them to use subpar materials to construct their lithium-ion batteries. It is often consumers who have to live with the consequences of these decisions when fires do break out. Any person injured by fire caused by a lithium-ion battery may be able to seek some measure of accountability through a bodily injury claim.
