Liability For Batavia Car Accidents

Driver intoxication remains one of the leading causes of car accidents in the United States. According to the NHTSA, “Every day, about 37 people in the United States die in drunk-driving crashes — that’s one person every 39 minutes. In 2021, 13,384 people died in alcohol-impaired driving traffic deaths — a 14% increase from 2020.” Alcohol and drugs can impair a person’s ability to drive safely in a number of ways.

  • Intoxicated drivers have a difficult time staying in one lane of traffic.
  • Intoxicated drivers have a difficult time maintaining a safe speed.
  • Intoxicated drivers are more likely to fall asleep during their trips.

Pursuant to Illinois Civil Code (625 ILCS 5/11-500), no person shall drive a motor vehicle under the influence of alcohol, drugs or intoxicating compounds. There is a rebuttable presumption of negligence on the part of any driver that hits a bicyclist or pedestrian while intoxicated. Victims of bicycle accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

People often drive drunk dozens of times before they are eventually caught or involved in a collision. Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the expenses that come with a serious accident. It is important that all evidence is preserved after any collision.
