Textron Specialized Vehicles Expands Recall For Numerous Arctic Cat Tracker Side by Side Recreational ROVs Over Crash Hazard
CHICAGO, ILLINOIS (November 14, 2024) – Textron Specialized Vehicles has expanded its recall for numerous Arctic Car and Track ROVS because they can pose a crash hazard.
The recall was issued on October 17, 2024. Around 7,000 affected units were sold, including 700 sold in Canada.
A major concern with the vehicles is that they can move when placed on an included, even in “park” mode. This creates the possibility that the vehicles can roll away and pose a crash hazard.
The firm has received 12 reports of vehicles moving while in park. No injuries have been reported at this time.
Liability For Injuries Caused By ATVs and ROVs
Off-road vehicles have become increasingly popular and are involved in many serious collisions every year. According to the Consumer Product Safety Commission, “CPSC estimates that 94,700 injuries, associated with OHVs, were treated in U.S. hospital emergency departments in 2022. Over five years, ATVs were the vehicle involved in 92 percent of the OHV injuries.” There are a number of factors that can make off-road vehicles particularly dangerous.
- Many off-road vehicles lack advanced safety systems.
- Off-road vehicles have a high center of gravity, which makes them more susceptible to rollovers.
- Off-road vehicles are more likely to suffer mechanical failures than most traditional cars.
Companies that create off-road vehicles have a legal obligation to create vehicles that are reasonably safe. They must adhere to all consumer safety regulations. There are many known safety risks with ATVs and off-road vehicles. These should be mitigated to the greatest extent possible. Companies should also warn about the dangers associated with the use of their products. If a company fails to take reasonable steps to avoid creating faulty brakes, this could form the basis of a product liability claim. Victims of ATV accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
There are a number of reasons that an ATV may have issues with its brakes during park. In some cases, these machines may be built with cheaper components that are more likely to break over time. Sadly, though, companies will often do everything in their power to deny responsibility if their products injure someone. Any person injured by an ATV or off-road vehicle may have legal recourse through a civil claim.
