Liability for Lakewood Tree Fall Accidents
Property owners have a legal obligation to protect against reasonably foreseeable sources of harm. When a property owner has actual or constructive notice of a dangerous condition on their property, they must take action. Failing to take action could form the basis of a negligence claim. They must also take action to protect against trees that could potentially be hazardous. Property owners should take several measures to prevent trees on the premises from falling over.
- Property owners should conduct regular inspections of the trees on the property.
- Property owners should trim dead or overhanging branches, especially when those branches are above walkways or common pedestrian areas.
- Property owners should avoid any type of work that could damage the roots of a tree.
Determining whether or not a property owner is liable for an accident comes down to how foreseeable the accident is. If a tree showed signs of structural damage, this is a clear indication that it is at risk of falling over. Unfortunately, many property owners will not take any action if the tree is on their property and becomes prone to tipping over. It also matters whether or not other trees or tree branches have fallen in the area where the accident took place.
Steps to Take After Lakewood Tree Fall Accidents
Accidents involving falling trees are much more common than many people realize. According to The Weather Channel, “Multiple people are killed each year due to falling trees during storms or other weather, but there is no good record of the exact number.” Trees can weigh tens of thousands of pounds and can seriously injure any person that they hit. Multiple steps should be taken after any tree fall accident.
- Victims should seek medical treatment as early as possible.
- Any maintenance records related to the care of the tree should be sought.
- Victims that may have witnessed the incident should be interviewed early.
- Any parent with a child injured by a falling tree should contact an experienced personal injury attorney.
Accidents involving falling trees are often highly preventable. They tend to involve trees that show clear signs of rot or decay. Injuries involving falling trees can be absolutely devastating, especially for younger children. Any person injured by a fallen tree is able to seek some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
