Liability for Cook County CTA Bus Accidents
Many people are killed or seriously injured in bus accidents each year. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” There are several factors that can contribute to accidents with the commercial bus.
- Speeding: Roughly one-third of all fatal collisions in the United States involve at least one driver who is speeding.
- Distracted Driving: Driver distraction is another major cause of car accidents. This can include instances where drivers are distracted by their phone or GPS.
- Fatigue: Driver fatigue is much more dangerous than many people realize. It is estimated that staying awake for only 17 hours can reduce a person’s ability to drive safely equal to having a blood alcohol concentration of 0.05%.
Every driver has a legal obligation to take reasonable measures to avoid colliding with other vehicles. They must maintain a safe following distance with the vehicle ahead of them at all times. Pursuant to 625 ILCS 5/11-710, the driver of a motor vehicle shall not follow another vehicle more closely than would be reasonable and safe given the prevailing traffic conditions on the roadway. There is a presumption of negligence on the part of any driver that fails to slow down to avoid hitting a vehicle directly in front of them.
If the driver of a van or other commercial vehicle was working at the time of a collision, it is possible that their employer could potentially be held at fault. As a general principle, employers are vicariously liable for the wrongful actions of their employees insofar as those employees were working within the course and scope of their job duties. For example, a driver may have been transporting passengers when they were involved in a collision. Victims of bus accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
Many of the injuries associated with bus accidents will not be immediately obvious. Car accidents can leave victims filled with adrenaline that masks the presence of injuries. This is why it is so important that accident victims seek a thorough medical evaluation after any crash. This evaluation can help reveal latent injuries that may not have otherwise been noticed. Any person that is injured in a Chicago Transit Authority bus accident may be able to seek some measure of accountability through a personal injury claim.
