Liability For Palos Park School Bus Accidents

Accidents involving school buses are much more common than most people may realize. According to the National Safety Council, “From 2012 to 2021, about 70% of the deaths in school bus-related crashes were occupants of vehicles other than the school bus, and 16% were pedestrians. About 5% were school bus passengers, 5% were school bus drivers, and 3% were pedalcyclists.” There are a number of reasons that school buses can be particularly dangerous.

  • School buses have large blind spots that can obscure the presence of other vehicles.
  • School buses are much more difficult to stop than passenger vehicles.
  • School buses have a high center of gravity and are much more prone to rollover collisions.

School bus drivers are considered common carriers and are held to a high standard in terms of safety. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601), all drivers must not operate their vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting another vehicle, this could form the basis of a negligence claim.

Liability for any collision could extend beyond any driver. The company responsible for maintaining a vehicle could be held at fault for a collision. Many accidents involving brake failures involve vehicles that are not properly maintained. Or, in some cases, a driver may neglect performing needed maintenance on their vehicles. Victims of car accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Many of the injuries associated with any bus accident may not be apparent for several weeks or months after any collision. It is important to seek medical treatment for any serious collision. Any person injured in a bus accident may be able to seek some measure of justice through a bodily injury claim. A bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
