Liability In McHenry County Motorcycle Accidents

Motorcyclists are uniquely vulnerable in car accidents. According to the Insurance Information Institute, “Motorcycles are by their nature far less crashworthy than closed vehicles. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles. Operating a motorcycle requires a different combination of physical and mental skills than those used in driving four-wheel vehicles.” There are a number of steps that drivers should take in order to avoid hitting motorcyclists.

  • All drivers should scan the road ahead of them.
  • All drivers should check their blind spots before making turns.
  • All drivers should slow down during times of reduced visibility.

Every person operating a vehicle as a legal obligation to exercise due care in order to avoid collisions. Many car accidents are due to drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code 625, no driver shall turn left through an intersection unless such a movement can be made with reasonable safety. They must yield the right-of-way to all traffic traveling from the opposite direction that is close enough to pose a hazard. There are a number of steps that should be taken after any collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • An independent investigation should be conducted.

The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help with many of the unexpected expenses that come with the sudden loss of a loved one. In order to win any civil claim, plaintiffs will have to demonstrate negligence. This is why it is so important that evidence is properly preserved after any collision.
