Liability For Chicago Scooter Accidents

Electric scooters have become increasingly popular, which has fueled a surge of accidents. According to UC San Francisco, “E-bicycle injuries doubled every year from 2017 to 2022, while e-scooter injuries rose by 45 percent each year. Injured e-riders tended to be slightly older and wore helmets less often than conventional riders. And e-scooter riders were more likely to sustain internal injuries than conventional scooter riders […].” There are a number of factors that could contribute to scooter accidents.

  • Scooter accidents are more likely to happen at night and during periods of reduced visibility.
  • Scooter accidents tend to happen when drivers are making turns at intersections.
  • Scooter accidents often involve drivers who are distracted or fatigued.

Drivers have a legal obligation to take reasonable steps in order to avoid hitting scooter riders. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. Victims of scooter accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The vast majority of scooter accidents are preventable. They often involve drivers that are not paying adequate attention to the road ahead of them. This is particularly true when drivers are making turns. Scooter riders have a small profile and can be easily overlooked if drivers are not paying attention. Any person injured in a scooter accident may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
