Liability for West Englewood Car Accidents
Drivers have a legal obligation to use caution to avoid colliding with any pedestrian in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, “every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, or any person operating a bicycle or other device propelled by human power and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person.” There are many ways that a driver may have acted negligently prior to hitting a pedestrian.
- A driver may have failed to reduce their speed.
- A driver may have failed to check their blind spots before turning into an intersection.
- A driver may have been distracted by looking at their cellphone.
- A driver may have been under the influence of drugs or alcohol.
If a driver fails to slow down to avoid colliding with a pedestrian in the roadway, this could be construed as negligence. When a driver flees the scene of an injury collision, they could also face criminal charges. Depending on the specific facts of any case, liability for a collision could extend beyond any specific driver deemed to be at fault. A city could face liability for a crash if a roadway was in a dangerous condition.
Steps to Take After Cook County Pedestrian Accidents
Pedestrians lack the protection of enclosed vehicles and are more likely to be seriously injured in the event of a collision. According to the IIHS, “Deaths from motor vehicle crashes with pedestrians have increased 78% since reaching their low point in 2009 and account for 18% of crash fatalities. The rates of pedestrian crash deaths per 100,000 people are highest for people ages 20 and over.” Certain steps should be taken after any pedestrian accident.
- Victims should seek medical attention as early as possible.
- Photos of the accident site should be taken.
- Any fragments left by a fleeing vehicle should be preserved.
- Any person injured in a pedestrian accident should carefully consider their legal options with a pedestrian accident attorney.
Victims of pedestrian accidents routinely suffer very serious injuries. These injuries can impact their ability to work and even perform daily tasks. They may also be left with high medical bills to treat those injuries. It is important that victims understand that they are protected by a number of laws. They are able to see some measure of accountability through a civil claim.
