Liability for Illinois Semi-Truck Accidents

Semi-trucks can be particularly dangerous for pedestrians and those in smaller vehicles. According to the IIHS, “Thirty-two percent of passenger vehicle occupants killed in two-vehicle crashes with a large truck in 2022 were in vehicles struck head-on by the truck and another 25% were in vehicles that were side-struck by the truck. Twenty-one percent involved the front of the passenger vehicle striking the rear of the large truck.” A number of different factors could contribute to a semi-truck accident.

  • Semi-truck accidents are more likely if a truck driver is fatigued. In fact, fatigue can be just as dangerous in certain circumstances as alcohol use.
  • Semi-truck accidents are much more likely at intersections.
  • Semi-truck accidents are much more likely when a truck is not being adequately maintained.

A fully loaded semi-truck can weigh 80,000 pounds. These vehicles take much longer to stop than passenger vehicles and must be driven with extreme caution for the safety of others. If a semi-truck driver fails to take appropriate action to avoid hitting another vehicle, this could form the basis of a negligence claim. There are several parties that could potentially be liable for any semi-truck accident.

  • The carrier that a truck driver worked for could be held at fault.
  • The company that loaded the cargo on a truck could also be held at fault. Many truck accidents are due to cargo shift.
  • The company responsible for inspecting and maintaining a truck could bear some liability for a collision.

Truck accidents are often highly complex events. The factors that contribute to any truck accident could take place days, weeks, or even months prior to the actual collision. It is imperative that every semi-truck accident is thoroughly investigated. An investigation can help reveal all of the liable parties. Any person injured in a semi-truck accident may be able to seek some measure of accountability through a bodily injury claim. A truck accident attorney can examine the unique facts of your case and let you know what your legal options are.
