Liability for Jacksonville Home Explosions

Gas companies in Illinois have a legal obligation to maintain their premises and equipment in a reasonably safe condition. They must take certain safety measures to protect against the possibility of natural gas explosions. If a gas company has actual or constructive notice of a dangerous condition with their property, they must take action. Failing to take action could form the basis of a negligence claim. There are several ways that a gas company may have acted negligently and contributed to a home explosion.

  • Maintenance: A gas company may have failed to properly maintain and inspect their lines. In particular, they may fail to respond to known pipeline deterioration.
  • Response: A gas company may fail to respond to a call about a gas smell at a residence. It is possible that a technician failed to shut off gas, despite suspicious indications that there was a leak.
  • Leak Detection: A gas company may have failed to perform leak detection services. These can help detect small problems before they turn into dangerous hazards.

When a gas company fails to take reasonable measures to protect customers from explosions, they could be held liable in the event of an accident. Home explosions are often complex events. There could actually be several liable parties for any particular incident. This may include the company that created any home appliance. An appliance may leak natural gas and set the foundation for a disaster.

Steps to Take After Home Explosions

Many people are seriously injured or killed in natural gas explosions every year. According to WBTV, “since 2010 there have been more than 2,700 gas leak incidents across the country that were considered significant, and that 362 of those incidents resulted in explosions. Additionally, those incidents have injured nearly 700 people and killed more than 140.” It is important that victims of gas explosions take certain steps to protect their rights.

  • Medical Evaluation: Victims should seek a thorough medical evaluation to identify and treat all of their injuries.
  • Evidence Preservation: Victims should take plenty of photographs of the accident site to help document what happened.
  • Accident Report: Victims should seek the accident report of the incident to understand the cause of the explosion.
  • Guidance: Victims should seek the guidance of an experienced premises liability attorney.

Home explosions can be absolutely devastating for those affected. The victims are often left with catastrophic injuries. They may also lose their home and belongings in the process. Any person injured in a home explosion may be able to seek some measure of accountability and justice through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
