Liability for Injuries at Manufacturing Plants

Thousands of workers are seriously injured or killed every year in the United States. According to the Bureau of Labor Statistics, “Private industry employers reported 2.6 million nonfatal workplace injuries and illnesses in 2023, down 8.4 percent from 2022, the U.S. Bureau of Labor Statistics reported today. This decrease was driven by a 56.6-percent drop in illnesses to 200,100 cases in 2023, the lowest number since 2019.” There are a number of potential hazards for workers at a manufacturing plant.

  • Workers are susceptible to being injured by machines.
  • Workers may be injured by slips, trips, and falls.
  • Workers may be exposed to toxic substances and other chemical hazards.
  • Workers in a manufacturing setting may sustain injuries from performing repetitive tasks.

When a worker is injured or killed in a manufacturing setting, they or their family may have recourse through a worker’s compensation claim. Worker’s compensation is a no-fault insurance plan that can help a worker or their family after a serious accident. An injured worker may also be able to recover damages through a third-party liability claim. A third-party claim could be possible if an entity separate from a worker contributed to an accident. There might be numerous sources of third-party liability.

  • The company that manufactured a piece of machinery could be held at fault. This includes the companies that made the component parts of that machinery.
  • The owner of a piece of property could also face liability. Property owners have a legal obligation to maintain their premises in a reasonably safe condition.
  • The suppliers of raw materials, chemicals, or other products could be liable if the material was contaminated in some way.

It can be hard to know what to do after being injured on the job. Many victims will be left with serious injuries that impact their ability to be gainfully employed. It is important for workers to understand that they do have rights. They may be able to seek damages through a civil claim.
