The injuries were allegedly caused by children aged four and five. A full investigation into the Pershing Early Learning school bus attack remains ongoing at this time.
Liability for Macon County Attacks at School
Violence in a school setting remains alarmingly common. According to the National Center for Education Statistics, “About 857,500 violent incidents and 479,500 nonviolent incidents were recorded by public schools in 2021-22. Sixty-seven percent of public schools reported having at least one violent incident.” Violence can come from many different sources, but bullying remains a huge factor. There are a number of steps that schools should take to reduce bullying and attacks.
- Schools should establish clear policies related to bullying. They should define it and have a zero-tolerance policy.
- Schools should promote awareness and education. This may include conducting anti-bullying workshops.
- Schools should create a culture of kindness, inclusion, and respect.
Schools have a legal obligation to protect students from reasonably foreseeable sources of harm. This includes attacks at the hands of teachers and other students. To that end, schools must properly monitor students at all times of the day. They must also heavily enforce all regulations necessary for their safety. When small children are traveling on a bus, there should typically be a school monitor, since the bus driver must be focused on driving. It is important that certain steps are taken after any attack on a school bus.
- Surveillance footage should be sought.
- A police report should be created.
- Eyewitnesses should be interviewed.
- An experienced personal injury attorney should be contacted.
The vast majority of attacks in a public school setting are preventable. They tend to involve systemic failures within a school setting, as opposed to the negligent actions of a single person. For example, school officials may have ignored reports about bullying or that a certain student posed a threat to other students. It is important that victims of these attacks understand that they do have rights. The family of any child who is attacked at school or on a school bus may have legal recourse through a civil claim.
