Liability For Mundelein School Bus Accidents

School buses tend to be very safe for their passengers. According to the NHTSA, “American students are nearly eight times safer riding in a school bus than with their own parents and guardians in cars. The fatality rate for school buses is only 0.2 fatalities per 100 million vehicle miles traveled (VMT) compared to 1.5 fatalities per 100 million VMT for cars.” But accidents still happen and they can leave victims with serious injuries. There are a number of factors that could contribute to a school bus accident.

  • Accidents are much more likely to occur during periods of reduced visibility or inclement weather.
  • Accidents tend to happen at intersection when drivers are making turns.
  • Accidents often occur when one or more drivers are speeding.

School buses are considered “common carriers” and are held to strict safety standards set forth in the Common Carrier Liability Act (740 ILCS 25/). All school bus drivers must exercise due care to avoid collisions. When the roads are bad drivers must slow down below the speed limit. If a school bus driver fails to slow down to avoid a collision, this could form the basis of a negligence claim.

The company or school district that a school bus driver worked for could also be held at fault for a collision. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are many steps that should be taken after a school bus accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

Many people who are injured in school bus accidents may not realize the full extent of their injuries for several weeks or months after a collision. Any person that is injured due to the negligent actions of a school bus driver may have legal recourse through a bodily injury claim. It is crucial that all evidence is properly preserved after an accident.
