Wemfg Children’s Multi-Purpose Bike Helmets Recalled Over Federal Safety Violations and Risk of Head Injury
CHICAGO, ILLINOIS (January 16, 2025) – Wemfg Children’s Multi-Purpose Bike Helmets have been recalled because they can pose a serious injury risk to children.
The recall was issued on January 8, 2025. Around 6500 units were sold before the recall went into effect.
According to the recall notice by the Consumer Product Safety Commission, the helmets do not comply with positional stability and impact labeling requirements. The helmets may fail to protect the user in the event a crash takes place.
This can leave users at risk of a serious head injury. No injuries have been reported at this time. The Wemfg Children’s Multi-Purpose Bike Helmets were sold exclusively on Amazon prior to being recalled.
Affected units come in a variety of color combinations, including blue/pink, green/blue, green/blue/purple, pink/blue/green, and several other combinations.
Liability for Head Injuries Caused by Defective Helmets
Bicycle accidents remain one of the leading causes of preventable injury for children. This is why bicycle helmets are so important. According to the Bicycle Helmet Safety Institute, “Helmet use was associated with a significant odds reduction for serious head injury irrespective of type of bicycle crash. The highest reduction was seen for bicycle vs. bicycle collision, followed by single bicycle crash and then collision with a motorized vehicle.” But many bicycle helmets failed to perform as intended. There are a number of reasons why this might be the case.
- A bicycle helmet may have inadequate impact resistance.
- A bicycle helmet may have a poor fit system.
- A bicycle helmet may have material failures, which include defects with the foam.
- A bicycle helmet may fail to buckle chin straps properly.
- A bicycle helmet may be composed of cheap materials.
Depending on the facts of any case, the company that made a bicycle helmet could be liable if it failed mid-use and caused the rider to suffer an injury. Companies that manufacture bicycle helmets have a legal obligation to ensure that they’re reasonably safe. They must comply with all safety regulations set forth by the Consumer Product Safety Commission. They must also test their helmets and all the ways that they are likely to be used and misused. If a bicycle helmet has design flaws that make it more likely that it will fail, this could form the basis of a strict product liability claim. It is important that several steps are taken after any accident involving a faulty bicycle helmet.
- Medical records related to the incident should be collected.
- It should be determined if the bicycle helmet involved in the accident was part of any recall.
- The helmet itself, and any fragments from the crash, should be collected and preserved.
- An experienced product liability attorney should be contacted.
It can be hard to know where to begin if your child has been injured in a bicycle accident. These accidents can be exponentially worse if the helmet designed to protect them fails for some reason. In many instances, these failures are preventable and the result of deliberate choices about how the helmet is made. Part of the problem is that the helmets may be manufactured in countries that don’t have as strict design standards as the United States. The family of any child injured by a faulty bicycle helmet may have legal recourse through a civil claim.
