Liability For Chicago Pedestrian Accidents
Car accidents remain a serious hazard for pedestrians across Chicago and Illinois. According to the Chicago Department of Transportation, “Nearly 90% of traffic deaths in Chicago involve reckless behavior by people behind the wheel.” There are a number of measures that cities should take in order to reduce the prevalence of pedestrian collisions.
- Cities should install pedestrian-friendly infrastructure, including pedestrian islands.
- Police officials should heavily enforce traffic infractions likely to lead to pedestrian collisions.
- Cities should study which intersections have the most accidents.
Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Several steps should be taken after any hit-and-run collision.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- Fragments of the fleeing vehicle should be collected.
If a driver fled the scene of a collision, they could face criminal as well as civil liability. The vast majority of pedestrian accidents are preventable and involve some amount of driver error. This could include instances where drivers are distracted or speeding. Any person injured in a car accident may be able to seek some measure of justice through a civil claim.
