Liability For Chicago Transit Authority Bus Accidents
Many people are seriously injured in accidents involving Chicago Transit Authority buses every year. According to ABC 7, “For CTA buses, that crash factor is 36 hours. Every day and a half in Chicago, a city bus is involved in a crash and the I-Team discovered a surprising number of injuries in CTA accident reports.” Bus drivers should take a number of measures in order to prevent collisions.
- Bus drivers should check their blind spots before making turns.
- Bus drivers should use their horns when necessary to let other drivers know of their presence.
- Bus drivers should slow down during periods of reduced visibility.
Buses are considered “common carriers” and are held to strict safety standards set forth in the Common Carrier Liability Act (740 ILCS 25/). Handling a bus is substantially more difficult than driving a passenger vehicle. As such, bus drivers must use the utmost caution in order to avoid collisions. If a bus driver fails to slow down in order to avoid colliding with another vehicle, this could form the basis of a negligence claim. It is important that certain steps are taken after any bus accident.
- The work logbook for the bus driver involved should be reviewed.
- Surveillance footage should be sought.
- Medical records related to the accident should be preserved.
- The history of collisions at the accident site should be understood.
Depending on the facts of any case, liability for a Chicago Transit Authority bus accident could extend beyond any driver. For example, the city of Chicago could bear some liability for the collision. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. The family of any person that died in a Chicago Transit Authority bus accident may have legal recourse through a civil claim.
