Liability For Illinois Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured in pedestrian accidents every year in the United States. Elderly pedestrians are particularly at risk. According to the Centers for Disease Control, “Adults ages 65 years and older accounted for about 17% of the U.S. population in 2021. However, this group accounted for 21% of all pedestrian deaths in 2021.” Collisions are more likely to happen in urban settings and at intersections. There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should check their blind spots before turning.
  • Drivers should slow down during periods of inclement weather.
  • Drivers should be well rested before heading out onto the road.
  • Drivers should abstain from alcohol and other intoxicating substances.

Drivers must do everything in their power to avoid harming pedestrians. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. When a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps be taken after any pedestrian collision.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • The police report for the collision should be collected.

Depending on the facts of any case, liability for a pedestrian collision could extend beyond any driver. Pickup trucks are often used for commercial purposes such as landscaping or construction. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. It is important for accident victims to understand that they do have rights. The family of any person who died in a pedestrian collision may have legal recourse through a civil claim.
