Liability for Spring Grove Industrial Accidents

Employers in Illinois have a legal obligation to maintain worksites in a reasonably safe condition. They must abide by all OSHA regulations. This is especially important at manufacturing sites where heavy equipment is being used. There are a variety of different factors that may contribute to any manufacturing accident.

  • Machine Failures: Machine failures remain a major factor in manufacturing accidents.
  • Lockout/Tagout: Many accidents are preceded by workers not following the proper lockout/tagout procedures.
  • Hazardous Conditions: Manufacturing accidents are much more likely if workers are forced to perform their job duties in hazardous conditions. This could include situations where there is poor lighting or visibility. Excessive noise can also contribute to miscommunications.
  • Violations: OSHA violations are a routine contributing factor in manufacturing accidents. Among other things, workers could be asked to work with equipment that lacked proper machine guards.

When a worker is injured in Illinois, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help workers recover damages. In addition to workers’ compensation, an injured worker may also be able to pursue damages through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.

Steps to Take After Illinois Industrial Accidents

The manufacturing industry continues to be overrepresented each year in terms of the number of workers seriously injured or killed. According to Manufacturing Dive, “The manufacturing industry saw 355 workplace fatalities in 2024, according to data from the Bureau of Labor Statistics released Thursday. Fatalities decreased by about 10% from 2023, when 393 on-the-job deaths were recorded. BLS initially published that 2023 saw 391 fatalities.” Multiple actions should be taken after any industrial accident.

  • All of the medical records related to the incident should be sought.
  • Photos of the accident site should be taken.
  • Any report created by OSHA should be collected and reviewed.
  • Victims should consider their legal options with an experienced personal injury attorney.

Workplace accidents are often highly preventable. They tend to be the result of multiple safety lapses. This can include situations where workers are not given adequate training on the correct lockout/tagout procedures. It is important the victims of industrial accidents understand that they do have legal rights. They are able to seek some measure of accountability through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
